According to the Society for Human Resource Management, more than half of employers (57%) conduct drug tests on all job applicants.  The tight labor market and the lingering effects of the recent recession have only increased the number of employers who routinely drug test their employees and job applicants.  If you’ve been looking for a job in the last five years, the chances are that you’ve been asked to submit to a drug test.

Regardless of whether the drug test you took was accurate or not, you have important rights under federal law - - rights that should be protected.  To be clear, even if you tested positive for drug use and the test was accurate, you are still protected by the law.  So, if you have lost a job or been denied employment based on a drug test, you may have a claim against the employer and/or the company that arranged for the drug test.
